Legal Agreement and Binding Nature

These Terms and Conditions constitute a legally binding agreement between you (the "User" or "Student") and Growth Labs Educational Services (the "Company," "we," "us," or "our"). By accessing our website, enrolling in our courses, or using any of our educational services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions in their entirety.

This agreement governs all aspects of your relationship with Growth Labs, including but not limited to course enrollment, payment obligations, intellectual property rights, liability limitations, and dispute resolution procedures. If you do not agree with any provision of these Terms and Conditions, you must immediately cease use of our services and refrain from enrolling in our educational programs.

These Terms and Conditions are effective from the date of your first interaction with our services and remain in force until terminated in accordance with the provisions outlined herein. We reserve the right to modify these terms with appropriate notice to users.

User Obligations and Legal Responsibilities

1. Legal Compliance and Conduct Requirements

As a user of Growth Labs services, you are legally obligated to comply with the following requirements:

  1. Age Verification: You must be at least 16 years of age to use our services independently, or have legal guardian consent and supervision
  2. Identity Accuracy: All personal information provided during registration must be true, accurate, and complete
  3. Legal Capacity: You must have the legal capacity to enter into binding contracts under applicable law
  4. Compliance with Laws: You agree to comply with all applicable local, national, and international laws and regulations
  5. Respect for Rights: You must respect the intellectual property, privacy, and other legal rights of Growth Labs and third parties
  6. Professional Conduct: You agree to maintain professional and respectful behavior in all interactions with instructors and fellow students

2. Prohibited Activities and Behaviors

The following activities are strictly prohibited and may result in immediate termination of services and legal action:

  1. Intellectual Property Infringement: Unauthorized copying, distribution, or modification of course materials, software, or proprietary content
  2. Security Violations: Attempting to breach, hack, or compromise the security of our platform or systems
  3. Fraudulent Activities: Using false payment information, creating multiple accounts to circumvent restrictions, or engaging in any deceptive practices
  4. Harassment or Abuse: Engaging in discriminatory, threatening, or abusive behavior toward other users, instructors, or staff
  5. Commercial Exploitation: Using our educational content for commercial purposes without explicit written permission
  6. System Abuse: Overloading our servers, using automated tools, or engaging in activities that disrupt service availability for other users

3. Content Guidelines and Academic Integrity

Students must adhere to strict academic integrity standards and content guidelines:

  • Submitted work must be original and properly attributed when referencing external sources
  • Collaboration with other students is encouraged where permitted, but individual work must be clearly identified
  • Use of artificial intelligence tools must be disclosed and used in accordance with course-specific guidelines
  • Plagiarism, cheating, or academic dishonesty will result in course failure and potential legal action
  • Content shared in forums or group discussions must be constructive, relevant, and respectful

User Responsibilities and Indemnification

1. Legal Compliance and Regulatory Adherence

Users are solely responsible for ensuring their use of Growth Labs services complies with all applicable regulations:

  • Compliance with European Union data protection regulations (GDPR) when handling personal data learned through courses
  • Adherence to Finnish educational and consumer protection laws
  • Compliance with marketing and advertising regulations in your jurisdiction when applying course knowledge professionally
  • Respect for international copyright and intellectual property laws
  • Compliance with employment laws and professional ethics in your workplace application of course materials

2. Indemnification Obligations

You agree to indemnify, defend, and hold harmless Growth Labs, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses arising from:

  1. Your use or misuse of our educational services and platform
  2. Your violation of these Terms and Conditions or any applicable law
  3. Your infringement of any intellectual property or other rights of third parties
  4. Any false or misleading information provided during registration or course participation
  5. Your professional application of course knowledge in violation of applicable laws or regulations
  6. Any content you submit, post, or share through our platform

3. Privacy and Data Protection Responsibilities

Students are responsible for protecting their own privacy and that of others when participating in courses. This includes maintaining confidentiality of sensitive information shared during group exercises, respecting the privacy of fellow students, and properly handling any personal data encountered during practical exercises. Students must not share login credentials or account access with unauthorized individuals.

Liability Limitations and Warranty Disclaimers

1. Disclaimer of Warranties

Growth Labs provides educational services "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:

  • Merchantability: We do not warrant that our services will meet your specific educational or professional requirements
  • Fitness for Purpose: We make no guarantees that course completion will result in specific career outcomes or salary increases
  • Non-infringement: While we respect intellectual property rights, we cannot guarantee that all content is free from third-party claims
  • Accuracy: Course content is provided for educational purposes and may not reflect the most current industry practices or legal requirements
  • Availability: We cannot guarantee uninterrupted access to our platform or services

2. Limitation of Liability

To the maximum extent permitted by applicable law, Growth Labs shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to:

  1. Loss of profits, revenue, or business opportunities
  2. Loss of data or course progress due to technical failures
  3. Professional or personal damages resulting from course application
  4. Costs of substitute educational services or materials
  5. Any damages arising from security breaches or unauthorized access
  6. Career setbacks or professional consequences from applying course knowledge

In no event shall Growth Labs' total liability to you exceed the amount paid by you for the specific course or service giving rise to the claim, calculated over the twelve months preceding the incident.

3. Force Majeure and Exceptional Circumstances

Growth Labs shall not be liable for any failure or delay in performance under these Terms and Conditions that is due to fire, flood, earthquake, elements of nature, acts of God, acts of war, terrorism, riots, civil disorders, rebellions, revolutions, or other similar causes beyond our reasonable control. In such events, we will make reasonable efforts to resume services and may extend course deadlines or provide alternative delivery methods where possible.

Legal Information and Dispute Resolution

1. Governing Law and Jurisdiction

These Terms and Conditions are governed by and construed in accordance with the laws of Finland, without regard to conflict of law principles. The following legal frameworks apply:

  • Primary Jurisdiction: Finnish law governs all contractual relationships and dispute resolution
  • Consumer Protection: Finnish Consumer Protection Act applies to individual consumers
  • Data Protection: GDPR and Finnish Data Protection Act govern privacy matters
  • Educational Standards: Finnish education legislation applies to course accreditation and standards
  • EU Regulations: Applicable European Union directives and regulations take precedence where relevant

2. Dispute Resolution Procedures

Any disputes arising from or relating to these Terms and Conditions shall be resolved through the following procedure:

  1. Direct Negotiation: Parties must first attempt to resolve disputes through good faith direct communication for a period of 30 days
  2. Mediation: If direct negotiation fails, disputes may be submitted to mediation through the Finnish Arbitration Institute
  3. Consumer Dispute Board: Individual consumers may appeal to the Consumer Dispute Board of Finland for disputes under €5,000
  4. Court Proceedings: Unresolved disputes shall be submitted to the exclusive jurisdiction of the District Court of Helsinki
  5. EU Online Dispute Resolution: EU consumers may access the ODR platform at http://ec.europa.eu/consumers/odr/

3. Severability and Enforceability

If any provision of these Terms and Conditions is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the following principles apply:

  • The invalid provision shall be deemed severed from these Terms and Conditions
  • The remaining provisions shall continue in full force and effect
  • The parties will negotiate in good faith to replace the invalid provision with a valid provision that achieves the same economic effect
  • No waiver of any breach of these Terms and Conditions shall constitute a waiver of any other or subsequent breach

4. Terms Modification Policy

Growth Labs reserves the right to modify these Terms and Conditions at any time. Significant changes will be communicated to enrolled students via email at least 30 days before taking effect. Continued use of our services after modifications become effective constitutes acceptance of the revised terms. Students who do not agree with modifications may terminate their enrollment and receive a prorated refund for unused course portions.
